Abstract

A research in primary subject studying the power of legislative in forming of the constitution before and after the amandment of 1945 Indonesian Constitution has one of its purposes. That purpose is to find out the different in forming of the constitution between The legislative and The President before and after the amandment of the 1945 Indonesian Constitution thus we can identity the change of the power position from The President's domination to the pattern of cooperation.
The method used in research is historical judicial and political theory. The substance in the research is normative law and in the end, the result concluded deductively.
The conclusion of the research is the existence of judicial guarantee to the increasing of the role of The Legislative in matter of Representative. There are some obstance in order to increasing the role of The legislative and also how the effort of increasing the role of The Legislative informing constitution after the amandments made.
