Abstract

Cosmetic products marketed in Indonesia must (das sollen) have marketing
authorization number in the form of a notification issued by BPOM as a requirement
and proof that the cosmetics product is decent and safe to use. The Head of BPOM RI
stated (das sein) that cosmetic products did not have marketing authorization were not
supposed to be sold and used by the people for skin treatment because they might be
detrimental to their health, have fatal impact and impair kidney function. This research
aims at finding out: (i) law liability of Drug and Food Control Center (BBPOM) of
Yogyakarta in protecting consumers against cosmetics without marketing authorization
and (ii) the policies and efforts made to deal with cosmetics without marketing
authorization in the future.
This research is normative legal research. The data source used were primary data
obtained from interviews results and three types of secondary data from primary,
secondary and tertiary legal materials. The data collection method empoyed to obtain
the primary data was interview, while that used to obtain secondary data was through
documents related to the problem being studied.
The results of the research indicated that: (i) law liability of Drug and Food Control
Center (BBPOM) of Yogyakarta in protecting consumers against cosmetics without
marketing authorization was by giving administrative and criminal sanctions to those
who produced and / or distributed cosmetic products without marketing authorization
and (ii) the policies and efforts made to deal with cosmetics without marketing
authorization in the future ware based on the related laws and regulations, including the
improvement of the drug and food control system, the improvement of guidance for
consumers and businessmen, and improvement of information, communication and
collaboration.
